Probate is the legal process by which a person's estate is administered by the courts to pay all the deceased person's debts, gather the deceased's assets and distribute those assets according to the person's will. When a person has a will the probate process applies.
Estate Administration is the term used for distribution of a person's estate when there is no will. It is generally the same process as probate. The only difference is that when there is a Will the estate is distributed according to the Will. When there is no will the estate is distributed according to laws of succession drafted by the legislature.
A Trust avoids both of these processes by serving as a private means of distributing an estate without the intervention of courts.
